Terms of Use

Last updated: July 11, 2026

1. Agreement & Eligibility

Proving Ground is an independent study aid operated by Infinidatum LLC, providing practice questions and self-assessment tools for bar exams, aviation certifications, and other professional examinations. By creating an account or using the Service, you agree to these Terms of Use. If you do not agree, do not use the Service.

You must be at least 13 years old to create an account. If you are under 18, use this service only with the involvement of a parent, guardian, or instructor.

2. Accounts

You agree to provide accurate account information and to keep it current. Accounts are for a single person — one account per individual. You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account, and you agree to notify us promptly of any unauthorized access. To protect the Service from abuse, we may refuse sign-ups that use disposable or temporary email addresses.

3. Purchases, Credits & Refunds

Proving Ground is sold as one-time purchases of credit packs — Starter ($24 for 10 credits), Standard ($49 for 25 credits), and Pro ($99 for 60 credits). There is no subscription and no auto-renewal; you are only ever charged for a pack you choose to buy. Credits are account-scoped and non-transferable.

Attempts are sold as one-time purchases, not a subscription. A purchased attempt is non-refundable once you have started it. If you have unused attempts and believe you were charged in error, contact support before starting them.

Prices may change, but any change applies only to future purchases — never retroactively to credits you already hold. Stripe processes all payments on our behalf, and any applicable taxes are added at checkout.

4. Acceptable Use

You agree not to:

  • • Scrape, bulk-extract, or export our generated content
  • • Resell, republish, or redistribute our questions or practice materials
  • • Share your account with anyone else
  • • Attempt to extract the underlying question bank or the prompts used to generate it
  • • Use the Service to build a competing question set or study product
  • • Use the Service for any unlawful purpose

5. Intellectual Property

The generated questions, explanations, rubrics, and the SME-reviewed question bank are the property of Proving Ground and are licensed to you for your personal study only, not for redistribution or commercial use. You own the answers you write, and you grant us a license to (a) process your answers to grade them and return feedback, and (b) use them in de-identified, aggregate form to improve the quality of our questions.

Proving Ground is an independent study aid. It is not affiliated with, endorsed by, or approved by the National Conference of Bar Examiners (NCBE), any state bar, or the Federal Aviation Administration (FAA). Terms such as "MBE," "bar exam," "checkride," and "ACS" are used only to describe the subject matter our original practice questions cover.

6. Disclaimers

The Service is provided "as is," without warranty of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

This score is a self-assessment tool, not a prediction. Practicing here does not guarantee you will pass any real exam, and your results here don't indicate how an official examiner would grade you. Use it to find your weak spots — then keep studying.

Every question here is original. We never copy real exam questions or any copyrighted test material — all questions are generated by AI, then individually reviewed and approved by our editorial review team before they ever reach you. As we grow, this review panel is expanding to include credentialed experts in each field.

The Service is not legal, medical, or flight instruction, and it is not a substitute for official study materials or for a certificated flight instructor (CFI).

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, including lost profits or lost data. Our total liability for any claim arising out of or relating to the Service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for the result of any examination or certification attempt.

8. Indemnification

You agree to indemnify and hold Infinidatum LLC harmless from any claim arising out of your unlawful use of the Service or your violation of these Terms.

9. Termination

We may suspend or terminate your account for violations of the Acceptable Use terms in §4. You may delete your account at any time. If we terminate your account for cause, any unused credits are forfeit. If you close your account voluntarily, any unused credits are handled according to the refund policy in §3.

10. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. Except for claims that qualify for small-claims court, which either party may bring, disputes are subject to the courts located in Connecticut. If a binding arbitration clause is adopted, it will provide for individual (non-class) arbitration administered by the American Arbitration Association (AAA).

Needs counsel review: The arbitration language in this section is a placeholder. Consumer arbitration clauses have enforceability requirements that a B2B clause does not satisfy; this subsection must be drafted and reviewed by qualified counsel before any arbitration term is asserted as binding.

11. Changes & Contact

We may modify these Terms prospectively. We will notify users of material changes by email, and your continued use of the Service after a change takes effect constitutes acceptance. If you have questions about these Terms, contact us at admin@infinidatum.com.

DISCLAIMER: This is an operator draft for legal review and is not final legal advice. Before marketing Proving Ground publicly, these Terms must be reviewed and approved by qualified legal counsel licensed in the relevant jurisdiction.
